<p>Credit card debt. The sound of that should send shivers down yours and mine spine, but likely it does not. Credit card debt has become a fact of life, and truly &#8211; a way of life for millions of Americans. Some would argue that our entire U.S. economy in built upon debt; banks offering credit and consumers taking on debt to keep the wheels of our once robust economy turning. But at what price?</p>
<p>The consequences of this debt mentality and debt way of life have been staggering. Millions of Americans have upwards of 10, 20, 50, and even 80+ thousand dollars of credit card debt. With so much debt owed, making even the minimum monthly payments can become impossible or nearly impossible. Recent studies have shown that debt stress is a real medical condition. This debt stress can affect your emotional health, physical health, sleep, self-esteem, even your sex life. </p>
<p>Why has this become acceptable? Why are we a nation of consumers, rather than a nation of savers?</p>
<p>Is keeping up with the Jones&#8217; really that important? Is every new gadget that comes out really something we absolutely must have? Do our kids really need every new trendy thing that comes along? Must we continue to buy now and worry about paying it later? I, personally have friends and family that have struggled with debt and the treadmill of debt way of life. And I can tell you &#8211; it&#8217;s demoralizing. I realized through them that this is not the life for me, and in fact: it&#8217;s not the life for any of us. I offer you this advice: buy less and save more. I was just wondering what is the difference between Chapter 7, 10 &#038; 13 bankruptcies.  How did the new law that Bush passed now affect bankruptcies (or does it at all)?  I&#8217;ve heard everything that you can&#8217;t file for Chapter 13 bankruptcy anymore to you have to take financial planning classes thereafter.  Also, is it advisable at all?  I know normally people say make it your last resort, but I am beyond in debt and do not have any other resolutions.  Any horror stories after filing?  Any positive stories?  Please enlighten me.</p>

<p><i>Answer by fukinluckyfuker</i><br/>I filed the week before the laws changed, but I know a little about what changed.  </p>
<p>Ch. 7 is a liquidation, where your unsecured debts are discharged and not owed on anymore.  Secured debts can be reaffirmed in some cases.  This is the one that&#8217;s almost impossible to do now.</p>
<p>Ch. 13 is for debt restructuring.  There&#8217;s a formula they use to see how much money monthly you can afford to pay back.  If, when using this terrible formula created by the IRS, you can afford to repay even $  100 per month, you must file Ch. 13 and settle out your debts, over a maximum 5 year period.  </p>
<p>The dirty secret that no one talked about before the law changed, is that 4 out of 5 people who filed Ch. 13 BEFORE the change, failed.  You miss one payment and the whole thing can get derailed.  God help you if you lose a job, get injured, whatever.  </p>
<p>There are also some &#8220;means&#8221; tests, where your income is compared to the average income for your area.  If you make very little money, you may still qualify for a Ch. 7.  </p>
<p>And yes, I believe that before anyone can file a BK now, you must meet with a non-profit credit counselor first.  </p>
<p>Call a few BK attorneys.  Get quotes on prices, and meet with a couple that are cheap but seem knowledgable.  Most will give you at least a 30 minute consultation at no charge, in hopes of earning your business.</p>

Does any one have any experience w/ debt relief.<br />
My sister is in need of some help getting out of her mountains of bills due to a divorce and bad relationship decisions. She does not have the  luxury  of obtaining  a loan to help, due to her terrible credit.<br />
I told her to file for bankruptcy but she wants to avoid that route.<br />
Anyone have experience with this.<br />
Where would she find this consumer proposal?<br />
Is this an attorney?<br />

<p><i>Answer by Working on it.</i><br/>A consumer proposal may be a better option &#8211; where she will work with a bankruptcy trustee and come to a payment arrangement with the creditors.  She will have to make payments but less then paying it all back.  She can get a Citi Bank pre-paid credit card to keep building credit at the same time.</p>

I recently purchased a home (3 months ago) and financed 100% of the home. At this point I do not have an equity in the home. I am currently looking for a way to consolidate some of my debt to lower my rate, lower my payment, and ultimately pay off the debt sooner. I have 1 car loan, 1 personal loan, and 5 credit/store cards that I would like to consolidate totaling about $  16,600. My FICO score is currently 686, and I am on time every month with all of my bills. I have paid all bills on time (most of the time more than the minimum) for more than 3 years straight. My problem is that my Debt to Income ratio is probably too high for most lenders to consider me for a consolidation loan. What can I do to consolidate ALL of my debt? Any feedback would be appreciated.</p>
